The Court of Appeal has ruled that Al Ghurair should continue the printing of presidential ballot papers. The five judge bench has overturned the decision by the High Court to cancel the ballot papers printing tender which was given to Al Ghurair Printing and Publishing Company. The Appellate judge bench included Erastus Githinji, Roselyn Nambuye, Alnasir Visram, Professor James Otieno Odek and Jamila Mohammed.
The High Court had ruled that IEBC’s process lacked adequate public participation, but the Appeals Court ruled that public participation isn’t a mandatory requirement for direct procurement, adding that the high court judges didn’t take into account the hard reality that Kenya would not in all probability conduct an election on 8th August by ordering a fresh procurement process, “The learned Judges erred in law when they found that there was still time available to the appellant to procure election material,” said Justice Roselyn Nambuye.
