The High Court has directed parliament to enact legislation on the implementation of the two-third gender rule within sixty days or the parliament is dissolved. The ruling was delivered by Judge John Mativo, who gave an order outlining that parliament together with the senate failed to perform their duty, and violated gender rights in the process.
Judge Mativo said failure to pass the two thirds gender bill is a gross violation of the constitution.He also said anyone can petition Chief Justice David Maraga to advise the President to dissolve Parliament if the law is not passed.
This comes after increased calls for the two thirds gender rule to be implemented form various quarters. In a meeting that brought together women ODM aspirants at the Multimedia University of Kenya in Nairobi, ODM leader Raila Odinga had said that the current Jubilee administration has failed when it comes to ensuring the rule is actively functioning.
Last year, Parliament failed to pass the two-thirds gender rule bill on two occasions.
The parliament has failed to pass the gender bill on two occasions, and the National Assembly eventually failed to meet the deadline for enacting the gender law which was set on August last year.
Majority Leader Aden Duale has said the order isn’t possible to fulfill within sixty days, saying that the Judge’s decision isn’t practical.
