The body of a woman who was buried two years ago was exhumed at kusiahusia village of Marenga,in Port Victoria after a Busia court issued an order following a dispute among family members.
Busia Chief Magistrate Mr. Ismael Maisiba ruled that Lucia Ngira Ndege who died 18th June 2010 be exhumed after family members failed to resolve on where she would be buried.
The OCS, Joseph Mwangi disclosed that the body was carried to Tanaka mortury in busia till the case would be heard and decided.
Mwangi stated that after the woman had died, Mary Adhiambo filed the case to both her first brother Mr. William Ndege and the one who inherited her mother Mr. Joseph Okuku Aduasa who lives in Siginga claiming that are forcing her to bury her mother at Marenga which is not the right place to be buried, but it is reported she used to live in Marenga before she died at the age of 83.
“On the other side, her daughter wants her Mother burried in Maumau Rugunga southern part of Bunyala District where she was born,” said the OCS.
The court decided that according to the African culture the girl can’t decide where to bury her mother on behalf of the family member therefore; it passed that to the first born who is William Ndege and her inheritance Joseph Okuku to decide where to bury the body.
“But because the case was put off, the first born, William Ndege stole the body from the mortuary and buried her in Marenga, but after burial his sister Mary Adhiambo and the last born of Mr. Alfred Ndege tried to go to court, but they couldn’t manage till Wednesday when the OCS Mr. Joseph Mwangi with 30 police officers from Busia and Port Victoria marched into the home of Mr. Ndege with court order asking the port to be removed from the grave,” said area OCS.
“Member of the families and Mr. William Ndege were not called in court or shown that that the body will be removed from the grave for court hearing and even not knowing where the body was taken,” said Family members. Switch to Our Mobile Site |
