A man who defiled a minor three years ago has been sentenced to a 20 year jail term by a Busia law court.
The accused Basil Okaroni a resident of Okatikok village, Teso District in Busia County is said to have committed the offence against the minor, aged 14 years then, inside his house in June 2009, contrary to section 8(1) as read with section 8(4) of the sexual offences Act no. 3 of 2006.
According to the prosecution, the victim had gone to draw some drinking water in the house of the accused who later grabbed and knocked her down before defiling her, an incident that claimed her virginity.
The accused directed the child to wash her genitalia before threatening to kill her if she informed anybody about the incident.
The prosecution further revealed that Okaroni started giving presents to the victim including money, which raised suspicion forcing the girl to reveal the incident to her parents, who took her to the hospital where it was confirmed that she was defiled.
Delivering the judgment, the Chief Magistrate Kiarie Waweru said that he was satisfied beyond any reasonable doubt that the accused committed the offence he was charged with and was not falsely implicated.
“I find him guilty according to the charges against him hence convict him to serve 20 years in prison,” said the chief magistrate.
However, in mitigation the accused through his defense lawyer Erick Jumba pleaded leniency saying Okaroni is a family man and a first offender. Switch to Our Mobile Site |
