DPP accepts report for prosecution of Sudi

The Ethics and Anti-Corruption Commission (EACC) has been running an investigation on allegations that Kapsaret MP Oscar Sudi does not possess requisite academic qualifications and is suspected to have forged the documents he used in the 2013 general elections.

The anti-corruption commission says it has enough evidence to back the charges against the MP. Former CJ Willy Mutunga during the official release of the report said that tackling corruption must begin from the grassroots and that 80 percent of Kenyan politicians would be unfit to hold office if chapter six of the constitution on ethics and integrity was to be implemented fully.

EACC states that the Kapsaret MP furnished the electoral commission office with forged certificates as he sought the nomination in the 2013 general elections.

Information in the report revealed that the MP gave a false declaration under oath through a declaration form to IEBC.

It states that Sudi presented fake certificates to the Independent Electoral and Boundaries Commission (IEBC) during 2013 nominations noting that his Diploma certificate in Business management and Kenya Certificate of Secondary Education (KCSE) certificate was forged.

The report further says that Sudi lied under oath to both IEBC and EACC with the intentions of deceiving the two commissions.

This report was sent to the DPP’S office on June 17th 2016 with recommendations that Sudi should be charged with three counts of forgery, three counts of uttering false documents and two counts of giving false information which is contrary to the constitution.

This investigation followed information that was received by EACC in 2015 that the legislator did not have did not have the requisite academic qualifications.

EACC then filed a report against Sudi to the Director of Public Prosecution (DPP), Mr. Keriako Tobiko to charge him for false information and false statutory declaration which is against the constitution.

MP Oscar Sudi could face prosecution for allegedly faking his education certificates after the director of public prosecutions accepted a recommendation to charge him.
