For the second time in a row the High Court dealt a blow to the Kenya Kwanza government after declining to lift its first ruling not allowing the government to implement the 2023 finance bill that was passed into law by legislators two weeks ago.
In her ruling on Monday, Justice Mugure Thande of the High Court of Kenya said that after the consideration of the court of the many complains presented to court by the complainant led by Busia Senator Okiya Omtata, it was clear that the matter in question has legal issues and it was only good not to implement the 2023 finance act until the matter is heard and ruled justly.
Justice Thande explained that allowing the 2023 finance act to be implemented while the case is still in court will affect the common mwananchi and the complainant compared to the effect the government will get even if the case failed later on
The efforts of the defendants led by the laws on the government side to convince the court to allow the implementation of the 2023 finance act didn’t bear fruits.
The lawyers argued that if the court doesn’t allow the government to implement the new act, the move will jeopardize the government’s business.
However, the argument was met by a sharp tackle from the complainant lawyers who said that the government is allowed to continue using the 2022 finance act to continue collecting tax and implement government programs and agreement that was agreed upon by the court 2022
