The ruling for the criminal case MCCR/E879/2021 between the Republic of Kenya (state) and Martin Wamukota Situma (the accused), where the County Assembly of Bungoma, through the clerk Mr. John Mosongo had pressed charges of fraud and forgery, which basis was used to dismiss the accused as the senior sergeant at arms at the County Assembly of Bungoma was delivered at Bungoma law court 8 by Hon magistrate Odawo.
The magistrate ruled that the accused was unfairly arrested and accused, yet the evidence provided in court by the prosecution could not sustain any of the charges labeled against the accused.
The case was dismissed. Going forward, the accused will use the judgment to seek redress in the Labor Relations Court for reinstatement.
