The Court has ruled against the appointment of a new Communications Authority Director General, thus, the outgoing Director General Francis Wangusi will remain at the helm of the agency until a case challenging the appointment of Mercy Wanjau as CEO is heard and determined. COFEK (Consumer Federation of Kenya) had filed the case opposing her appointment and said the CA board has no authority to appoint a CEO.
Her appointment was announced last week on Thursday as the new acting Director-General by the CA Chairman Ngene Gituku. However, Wangusi, whose term expired, opposed the appointment, adding that her appointment had been rejected by the board but it was being forced by a few people with selfish interests. Wangusi, who said he learnt of her appointment through the media, had been issued with a notice to vacate the office.
COFEK had called for an independent body to preside over the hiring, noting that the appointment wasn’t constitutional due to a lack of a functional board. But CA maintained there is a board, albeit one that isn’t fully constituted.
