A three bench judge, has declined to suspend the Senate’s proceedings regarding the motion to impeach Deputy President Rigathi Gachagua. This ruling was made by Justices Eric Ogola, Anthony Mrima, and Frida Mugambi shortly after the court convened.
The judges stated that the Deputy President would have the opportunity to appeal to the court if he is dissatisfied with any decision made by the Senate during this process. This ruling follows an earlier decision by Justice Chacha Mwita, who had also granted a stay order on the impeachment process based on arguments presented by the Deputy President’s legal team, led by lawyer Paul Mwite.
Justice Mwita had allowed the Senate to continue with its proceedings regarding the impeachment motion, emphasizing the necessity for both the legislative and judicial branches to fulfill their respective responsibilities independently.
The Senate is expected to commence discussions on the impeachment motion this Wednesday, with sessions planned to continue today and tomorrow, Thursday. During these sessions, senators will review submissions from the National Assembly, which will be presented by the motion’s sponsor, Mwengi Mutuse, the Member of Parliament for Kibwezi West. Additionally, the Senate’s Legal Committee will be represented by Chairman George Murugara, also the Member of Parliament for Tharaka, alongside other committee members, including Otiende Amollo of Rarieda and John Makali of Kanduyi.
