The High Court in Kitale has thrown out the petition contesting the election of Endebess MP Dr. Robert Pukose. The petitioner, Dr. Robert Simiyu, wanted the court to overturn Pukose’s election due to what he termed as mishandling of the election by the Independent Electoral and Boundaries Commission (IEBC) and election irregularities.
He had also asked the Court to call for a re-tally of all the votes cast in the disputed elections to establish the authenticity of the winner and the votes.
High Court Judge Cecilia Githua threw out the petition, with costs accrued being KSh 2.5 million. Pukose’s supporters celebrated the verdict with calls for all the communities residing in Endebess constituency to live peacefully and work together.
However, Dr. Simiyu, who welcomed the ruling, urged his supporters to remain calm. “I welcome the ruling but call upon our supporters to remain calm as we study it further and we’ll announce the next course of action,” he said.
