Judiciary faulted for increased rape cases

Kabuchai member of national assembly James Lusweti Mukwe has urged the Judiciary to support the fight against rape and defilement cases in the country.

The MP said the Kenyan courts are giving powers to the rapists without figuring out the situation of the victims and asked the judiciary to review the laws to deny the perpetrators the right to be bailed out.

He decried the high cases of defilement in the area, insisting that the action should be taken and perpetrators brought to justice.

“It is sad for the suspect to roam freely continuing with the same vices yet he had been identified by those who knew him.  Many alleged rapists are still on the run, despite community reports of their whereabouts reaching the police.” The mp noted.

The MP said a person convicted of statutory rape should not be able to walk out of the court room in this country urging the judiciary to speed up the process of the people.

He also said that the point of having laws in place was to protect the less fortunate who cannot access justice.

However, the legislature said some rape cases still go unpunished as a result of flawed criminal procedures in the arrest, linking the act to the person and the police not carrying proper procedures before arresting the perpetrators and arraigning them in court.

He appealed for justice to a class seven pupil who was forced to abort by the person who impregnated her after he was bailed out in Bungoma law court.

“The judicial independence should not only intrinsic to the rule of law, but fundamental to the access of all other human right and at the state of the victim.” He said.

He urged that government’s gripe about the courts has nothing to do with bread and butter issues, but is narrowly focused on political turf.

The legislature vowed not to leave any stone not turned when issues of rape and defilement are brought before him.

He asked the school heads to abide by the law and corporate to write supporting letters to jail the suspects who try to shut the dream of school going girls.

He was speaking at Khachonge primary school where he was accompanied by other members of county assembly led by Kabuchai Chwele ward James Mukhongo.

Mukhongo reiterated not to turn down the June, 10 2016 mass demonstration at Chwele market to pressurize the county government of Bungoma to put up infrastructure and other sanitation.

The MCA faulted the county for failing to a county for twenty million shillings budgeted for renovation of the market.

The agitated MCA criticized the governor for false reports concerning the development at Chwele market.

He cited the report on achievement that was presented at Meru governors’ devolution agenda as being misleading to the county residents.

“The governor is telling the country that his government has put flood lights at Chwele yet the street lights that were put at the market are not functioning” he said.

“It is a shame for a market that is collecting millions of money for the county not to have toilets and no clear roads for business people.” he said vehemently.
