The Speaker of the National Assembly Justin Muturi has declared the seat of the MP for Kabuchai constituency vacant. In a gazette notice dated 18th December, 2020, Muturi said the seat became vacant with effect from the 4th December, after the death of the late James Lusweti Mukwe. This comes even as the body of the late Lusweti arrived at Sanandiki Primary School in Chwele, accompanied by a convoy of leaders, family and friends.

The body was airlifted from Nairobi and was escorted to Sanandiki through Kibabii University, Mayanja and Chwele, upon arrival at the Bungoma airstrip. There will be a public viewing and then planned speeches, and later in the evening, the late will be taken to his home. The burial is slated for Saturday, where different leaders, residents are expected to attend.

The former Kabuchai MP died from Arthritis on December 4th. Mid this year, his condition worsened and he was airlifted to the Karen hospital in Nairobi for further treatment after earlier admission at the Bungoma West Hospital. He was discharged and went back to Bungoma, where he received on and off treatment at the Moi Teaching and Referral Hospital in Eldoret. He was later admitted at the Nairobi Hospital, and was discharged, but his condition got worse after sometime and he was rushed back. He died a day later, aged 59.
