Kapenguria legislator Samuel Moroto has been arraigned in Kitale Law Court over accusations of destroying property of Agricultural Development Corporation ADC Suam Orchards worth Kshs.7Millions between April and June 2017.
The accused Mp however denied the accusations before magistrate Symphie Makila whose prosecution side had pleaded with the court to continue holding the complainant as they continue with some other investigations concerning the MP.
His defence team led by Advocates Gideon Barongo, Katama Ngeywa and Robert Chebii defended their client claiming the case before the court and accusations took place four years ago and that the accused person never took any plea, and that there was no evidence yet the accused person was arrested by police over the same accusations.
The defence argued that the accused person was a man of stature in the society and that the prosecution has not even provided them with the charge sheet for them to work on, blaming the prosecution for not being sincere over the accusations before the court while reading the judgement Magistrate Symphie Makila read.
“upon the rules of earlie file 2017 it is evident that the accused person did not take plea and no evidence that the accused person was summoned by police over the accusations stating the prosecutions has not shown any compelling reasons to deny accused person bond, I will grant him bail of Kshs 1m with one surety or a cash bail of Kshs.500,000,000.
The mention is next week Monday on 15th for directions and hearing on the same court.
