Deputy Chief Justice Philomena Mwilu and her co-accused have been released on a personal bond of Kshs 5 million each after being arraigned at the Milimani Law Courts, Nairobi. The DCJ along with Stanley Muluvi have been ordered to appear before the court on Wednesday. Magistrate Lawrence Mugambi noted that the accused persons were presented before the court past working hours and that prejudices them even if the court was to grant them bond and sureties given that the court offices and banks were closed.
He said the terms are temporary to secure their appearance in court and after Wednesday’s proceedings the court shall if necessary impose further conditions as it shall deem necessary. Deputy CJ Mwilu was arrested on Tuesday around 2 pm at the supreme court on the back of corruption charges and was taken to DCI offices for questioning before being whisked to the Milimani Law court.
In an earlier press conference, DPP Noordin Haji said there was sufficient evidence against DCJ Mwilu. He outlined the charges, which included abuse of her office for personal gain; Accepted a gift in the form of money in circumstances which undermined public confidence in the integrity of her office; Obtained execution of a security belonging to Imperial Bank Limited now in receivership by false pretence; Unlawful failure to pay taxes; Conducted herself in disregard of the law
