One of the petitioners in the recently concluded case in which a high
court in Eldoret ruled that 48 employees of the county assembly be
shown the door for failure to adhere to rules and regulations as
pertains employment now claims his life is in danger.
Silas Wafula was one of the petitioners amongst other two James
Omaria and Francis Chemwor in a case that they petitioned the county
assembly in an Eldoret labor law over what they termed as using
unlawful procedures of employing some 48 employees on permanent and
pensionable scheme while leaving out 6 others was unlawful thus
wanted the interpretation of the court.
The petitioners argued that the assembly employed some employees who
were related to the former MCAS claiming tribalism and nepotism was
practiced in employing of staffs giving evidences of MCAS employing
their children, wives , siblings and son in-laws on permanent and
pensionable schemes while leaving out other employees who qualified
but not politically connected or relatives to MCAS.
Following the evidence adduced in court, the Judge of the High
Court Nelson Abuodha ruled that the assembly errored in employment of
the staff as the procedure used was wrong suspending their employment.
“The court hereby declares that the appointment of 48 employees of the
county Assembly on July 1, 2016 as employees on permanent and
pensionable terms to the exclusion of the six was discriminatory and
amounted to unfair labor practices “read the Judge.
Following the ruling, the the assembly administration gave out letters
of suspension to the county employees as well as terminating their
monthly salaries that the staff enjoyed leading them to lose jobs
The ruling however has not gone down well with the staff employee
that were sacked and have gone ahead to threaten one of the
petitioners Silas Wafula.
According to the petitioner, he alludes that his life is in danger
following the former employees of the assembly alleging that they will
deal with him as he was the one that made them get sacked from their
jobs.
The petitioner noted that following the court’s ruling he has not
been able to conduct his business efficiently as he was faced with
several threats from employees who are baying for his blood claiming
he was the cause of their sufferings.
Speaking to the media after having recorded a statement from police
station, the petitioner however vowed to continue pushing for justice
for the lesser persons in the county claiming he will not be cowed by
some individuals whom their main aim is to destabilize the trend
they had taken .
